Terms & Conditions: Public Competitions 

Section 1: Values and Principles 

The DG Murray Trust (“DGMT”) is committed to promoting fairness, inclusivity, and a focus on socio-economic development through its competitions. To ensure that all activities reflect these values, the following terms and conditions outline the principles that must be followed when competitions are implemented (“Terms”).

  • Focus on Impactful Prizes

All Prizes should contribute to the positive socio-economic improvement of the Winner’s life.  Examples include educational resources and support, professional development tools (e.g., laptops, data packages, or work attire), small grants or resources for business start-ups or community projects, and gift cards for essential goods and services. 

Prizes associated with the alcohol, tobacco, or gambling industries are strictly prohibited. This includes vouchers or sponsorships from any companies closely associated with these industries as they do not align with DGMT’s values. 

In addition, the Promoter must avoid implementing luxurious or non-essential Prizes such as vacations and luxury goods. Instead, competitions should prioritise practical items that can provide long-term benefits, rather than short-term indulgences. 

However, this guideline does not preclude the issuing of vouchers with a monetary value that can be redeemed for a product or service. In addition, while cash Prizes are also not prohibited, they must be used with caution.

  • Inclusive and Fair Participation

The Promoter must ensure that all competitions contemplated in this document are accessible to diverse groups of people within the community, especially those from disadvantaged backgrounds. Competitions should be free to enter or come with minimal requirements to ensure inclusivity.

  • Ethical Partnerships

The Promoter may only collaborate with partners on the Competition whose values align with those of DGMT. Partner organisations should have a focus on community development, education, gender equity, social justice, environmental justice, economic upliftment and the like. The Promoter may not engage in any activities that could result in a conflict of interest.

  • Transparency in Rules

The Promoter must clearly communicate the terms and conditions of the Competition. The relevant Entry process, eligibility criteria, and Winner Selection Method must be fair and transparent and clearly stated in the relevant Competition announcement or communication.

  • Local Business Support

When possible, the Promoter must use the Competition as an opportunity to promote local businesses or previously disadvantaged groups by sourcing products or services from them as Prizes. 

  • No Discriminatory or Harmful Messaging

The Promoter must not perpetuate stereotypes, discrimination, or the marginalisation of any group through the Competition. The Promoter must ensure that the messaging and presentation of the Competition is respectful and inclusive.

  • No Gambling

The Competition is designed to promote socio-economic development and is not intended in any way to be a form of gambling. No purchase, payment, or other consideration is required to participate, apart from the mere cost of internet access or postage, where applicable. The outcome of the Competition is not determined by chance alone but involves an element of skill, knowledge, or creativity, as is defined by the Winner Selection Method. The Competition is conducted in compliance with all relevant laws and does not involve any form of betting or wagering.

Any terms set out in the table below will have the meanings ascribed to them in this table when used in these Terms.

PARTICIPATION ELIGIBILITY CRITERIA

Where the sole Promoter is DGMT, an incubated project of DGMT or joint venture funded by DGMT, the following participation eligibility criteria apply:

  • Participation in the ECD Connect October-November points competition is subject to the following requirements:
      1. Participant role: Open only to individuals who are principals or ECD programme owners.
      2. Location: Participants and their ECD programmes must be based in South Africa 
  • Restrictions: Individuals who are directors, employees, agents, partners, consultants, or immediate family members of these persons of ECD Connect, or its service providers, are not eligible for prizes.
  • Application deadlines:
    1. First round: 31 October 2025
    2. Second round: 30 November 2025

ENTRY SUBMISSIONS REQUIREMENTS

Method and format of Entry

Steps to enter (must be completed by the competition closing date):

  1. Submit the competition entry form.
  2. Sign up for ECD Connect.
  3. Add a preschool to your profile.
  4. Log at least one income or expense entry.
  5. Join the ECD Heroes community.

Some examples of app activities to earn points include: taking attendance, planning themes & activities, logging income and expenses, tracking child progress, completing online training courses, joining the community, completing your profile, and connecting with other ECD Heroes.

One account entry per participant: Participants who create multiple accounts to enter will be disqualified. 

PRIZE/S STRUCTURE

Prize Number

Ten prizes will be awarded in total (five in October and five in November). Each winner may receive only one prize in respect of the Competition

Prize Structure

Five winners will each receive a prize in both the October and November competitions

First prize (October Competition): Takealot voucher OR airtime sent to a phone number of their choice valued at R500

Second prize (November competition): Takealot voucher OR airtime sent to a phone number of their choice valued at R500.

All prizes will be distributed before the end of 2025.

Winner Selection Method

The 5 winners per month will have their entries double-checked to ensure they adhere to the rules.

All participants who earn more than 600 points will be entered into a draw and the final winners will be selected at random.

Once ECD Connect determines the winners, the decision will be final.

Winners will be announced within two weeks of the competition’s final date.

Winners will be notified via WhatsApp or SMS or phone call.

 

Section 2: General 

Definitions:

  1. Entrant” means a person who submits an Entry;
  2. Entry” means an entry submission sent by the relevant Entrant to participate in the Competition, in accordance with these Terms; and
  3. Winner” means the Entrant selected by the Promoter in accordance with these Terms to win the relevant Prize.
  4. Competition” refers to the ECD Connect October-November Points Competition.
  5. Promoter” refers to the DG Murray Trust and ECD Connect.

Entry requirements:

  1. Participation in (including submitting an Entry for) or implementation of the Competition constitutes acceptance of these Terms.
  2. A copy of these Terms can be found on the Website throughout the Competition Period or can be obtained by contacting the Contact Person. 
  3. Entries that are incomplete, illegible, or indecipherable will not be valid and deemed void. In the same light, participants who are found to have created fake data will not be eligible for prizes.
  4. Where applicable, an Entries must be the original work of the relevant Entrant. Any form of plagiarism or submission of work that is not the Entrant’s own will result in disqualification. By submitting an Entry, each Entrant represents and warrants that their Entry is their original work and does not infringe upon the intellectual property rights of any third party. 
  5. All intellectual property rights in the submissions will remain with the Entrants, but the Promoter may use, reproduce, and distribute the Entries for the purposes of the Competition and related promotional activities.
  6. By submitting an Entry, each Entrant grants the Promoter a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the submission in whole or in part, for any purpose related to the Competition and its promotion.
  7. The Competition requires only one Entry per person,  multiple entries from the same person will be disqualified.
  8. The Promoter may exclude any Entry which it believes in its sole discretion to be inappropriate, fraudulent, or based on misconduct.
  9. Any Entry received after the Closing Date will not be considered.
  10. Participants are expected to adhere to a code of conduct that includes respectful behaviour and good sportsmanship. Any form of cheating, harassment, or inappropriate behaviour will result in immediate disqualification.
  11. ECD Connect reserves the right to disqualify any participants from the competition who violate the competition rules. This process is conducted fairly and transparently to maintain the integrity of the competition.
  12. ECD Connect reserves the right to change the rules at any stage or to suspend the competition in case of fraud, technical failures, or other causes beyond its control.

Winner Selection:

  1. The Winner will be selected according to the Winner Selection Method. 
  2. The decisions of the Promoter in all matters relating to the Competition, including the official results and final points, are final and binding on the Entrants, and no appeals will be accepted

Prize/s:

  1. The Prize Structure applies.
  2. Each Prize is non-transferable, non-refundable, and cannot be exchanged for any cash alternatives in whole or in part.
  3. While the Promoter has taken care to make sure that each Prize is of a good quality, no warranties are given in respect of any Prize. As such, the Entrant accepts each Prize “as is”. 
  4. The Prize/s includes delivery within the borders of South Africa and the Winner will provide the Promoter with a valid daytime delivery physical address to enable delivery of such Prize/s.
  5. If a Prize is not available despite the Promoter’s reasonable endeavours to procure the Prize, the Promoter may substitute such Prizes with an item of equal value to the original Prize. 

Contacting Winners & Prize Distribution:

  1. The Promoter will contact the Winner using the contact details supplied to the Promoter in the relevant Entry.
  2. The Winner may decline the offer of the Prize.
  3. The Promoter will endeavour to contact the Winner once every day for 3 (three) consecutive working days after the date the Winner is chosen. Prizes will be distributed before the end of 2025, conditional upon the winner being duly notified and providing confirmation of their delivery address. However, the Promoter will not be responsible for any delays in delivery or non-delivery of a Prize.
  4. However, if the Winner cannot be contacted during this period, the Winner will forfeit the Prize, and the Promoter may select another in accordance with these Terms. 

No Right to Appeal:

  1. By entering this Competition, each Entrant acknowledges and agrees that the Promoter’s decisions regarding all aspects of the Competition, including but not limited to the selection of Winners and the awarding of Prizes, are final, binding, and conclusive. No correspondence or discussions will be entered into regarding the Promoter’s decisions.
  2. Entrants further acknowledge that participation in the Competition does not create any expectation, right, or guarantee of winning any Prize. The Promoter reserves the absolute right to alter, amend, or withdraw any aspect of the Competition at its sole discretion, without any obligation to compensate or notify Entrants. 

Privacy:

  1. The Promoter will comply with all applicable data protection laws (including but not limited to the Protection of Personal Information Act, 2013) and DGMT’s privacy policy (available at www.dgmt.co.za) at all times.   2. By entering this Competition, the Entrant explicitly consents to the collection and processing of their personal information for the purposes of this Competition.
  3. Entrants have the right to request access, change, or remove their personal details held by the Promoter. An Entrant may also revoke their consent to the processing of their personal information at any time, subject to legal or contractual restrictions and reasonable notice.
  4. The Promoter will store the Entrant’s personal information only for as long as is necessary to fulfill the purposes for which it was collected – to select the Winner/s – or as required by applicable laws and regulations (including but not limited to the Consumer Protection Act, 2008, and the Protection of Personal Information Act, 2013). 
  5. The Promoter will not share an Entrant’s personal information with third parties without the Entrant’s consent, unless required by law or necessary for the legitimate interests of the Competition.

Publication of Personal Information

  1. By entering this Competition, the Entrant explicitly consents to the Promoter publishing the Entrant’s name and likeness on social media platforms (including but not limited to Instagram, Facebook, TikTok, WhatsApp, Twitter/X, and LinkedIn), if the Entrant is chosen as a Winner.
  2. The Entrant may, at any time, opt out of the use of their name and/or likeness for promotional purposes by providing written notice to the Contact Person. Upon receipt of such notice, the Promoter will cease using the Entrant’s name and/or likeness in future promotional materials, although materials already in circulation may continue to be used.
  3. The Entrant acknowledges and accepts that each social media platform has its own applicable terms and conditions and privacy policy to which the Entrant’s published information may be subject.
  4. The Entrant will not be entitled to any payments or other remuneration for such publications or otherwise. 

Indemnity & Limitation of Liability:

  1. The Promoter and the Entrant each indemnify and hold DGMT harmless to the fullest extent permitted in law against any loss, damages, expense, cost, liability or injury of whatever nature and howsoever incurred by an Entrant, DGMT, the Promoter or a third party in relation to the ECD Connect October-November Points Competition and/or these Terms.
  2. The Entrant indemnifies and holds the Promoter (DGMT and ECD Connect) harmless to the fullest extent permitted in law against any loss, damages, expense, cost, liability or injury of whatever nature and howsoever incurred by the Entrant, the Promoter or a third party in relation to the Competition and/or these Terms.
  3. To the fullest extent permitted by law, DGMT and ECD Connect shall not be liable for any injuries, damages, losses, or for any special, incidental, indirect, or consequential damages arising out of or in connection with the Competition and/or these Terms. ECD Connect is further not responsible for technical failures of any kind

General Conditions:

  1. No purchase is necessary to submit an Entry.
  2. This Competition is in no way sponsored, endorsed, administered by, or associated with any social media platform used to market this Competition. 
  3. The Promoter shall maintain all records related to the Competition, including but not limited to entries, Winner selection, and Prize distribution, in compliance with legal requirements for auditing and reporting purposes.
  4. This Competition and these Terms are governed by South African law and subject to the exclusive jurisdiction of South African courts.
  5. Any dispute arising out of or in connection with these Terms will first be subject to internal negotiation in good faith between the relevant parties, failing which the dispute will be referred to a suitably qualified independent mediator, with the place of mediation to being Cape Town. Failing mediation, the dispute will be subject to binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa, with the place of arbitration being Cape Town.

We will make every reasonable effort to assist you, but during peak periods, responses may be delayed. Only issues reported through the official channels and within the competition window will be considered; unreported issues cannot be grounds for appeal against the final results. ECD Connect is not responsible for technical failures of any kind.
